The FTC sued Vemma Nutrition Company, Vemma International Holdings, Inc., CEO Benson K Boreyko, and top affiliate Tom Alkazin in August 2015 for their $200 million pyramid scheme.
Jessica Rich, Director of the FTC’s Bureau of Consumer Protection, said, “Rather than focusing on selling products, Vemma uses false promises of high-income potential to convince consumers to pay money to join their organization.”
Federal Trade Commission (FTC) Calls Vemma A Pyramid Scheme That Preys On Young Adults
The Federal Trade Commission (FTC) shut down Vemma after finding it deceived members, especially young adults.
Boreyko’s 2004 firm soon expanded to college campuses nationwide. 2013 and 2014 were profitable years. College entrepreneurs were tempted to exaggerate claims of automobiles and boats.
FTC said the company’s major business was recruiting distributors (mainly college students). The starter set costs $600 plus monthly fees. Most members lost money because they believed the high-income claims.
US District Judge John Tuchi’s order prompted Vemma to halt multi-level marketing in 2015.
According to the FTC, Vemma’s business model is “a classic pyramid scheme that compensated participants mainly for enrolling others in the network, rather than for retail sales based on legitimate consumer demand for Vemma’s beverages.” The agency successfully got an injunction to stop the company from doing business.
Vemma Agrees To Ban On Pyramid Scheme Practices To Settle FTC Charges
According to the FTC case, the corporation agreed to stop using pyramid schemes.
The order also prohibits Vemma from making deceptive income claims or making unsubstantiated health claims and involvement in chain marketing schemes. “Unfortunately, the MLM industry continues to be plagued by extravagant income claims and compensation systems that favor recruiting over sales,” stated Jessica Rich, Director of the FTC’s Bureau of Consumer Protection.
Tempe’s Vemma Settles With FTC; Fined $238 Million, Admits No Wrongdoing.
FTC and Vemma settled in 2016. The company agreed to change its pay structure and pay the penalties. Vemma and CEO BK Boreyko must also present 20-year compliance reports. They lost business and real estate holdings.
Tom and Bethany Alzakin was fined $6.7 million and compelled to surrender real estate and business assets.
Vemma And Herbalife
Bill Ackman of Perishing Square said Vemma and Herbalife had “strong structural parallels” upon Vemma’s shutdown.
Bill Ackman believes Herbalife is a pyramid scheme like Vemma and other FTC-shuttered MLMs.
